Welcome to Retro-Loox. The terms "we," "us" and "our" refer to our company, which operates the Retro-Loox store and website at retro-loox.com, including all related content, features, tools, products and services (the "Services"). Retro-Loox is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (the "Terms"), set out your rights and responsibilities when you use the Services.

Please read them carefully. They contain important information about your legal rights, including warranty disclaimers and limits on our liability.

By visiting, interacting with or buying from us, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms you confirm that you are at least the age of majority where you live, and that any minor in your care who uses the Services on a device you own or manage does so with your permission.

To use the Services you may need to give us information such as your email address and your billing, payment and shipping details. You confirm that everything you give us is accurate, current and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

SECTION 2 — OUR PRODUCTS

We sell retro-style digital cameras and accessories, including the LOOX 60™, LOOX 83™, LOOX 84™, LOOX 91™ and LOOX 98™ ranges and related casings and accessories.

We work hard to represent our products accurately. Even so, color and appearance can differ from what you see on your screen depending on your device and its settings. We do not warrant that a product's appearance or finish will match how it is rendered online.

Product descriptions and specifications may change at any time at our discretion. We may discontinue any product, and we may limit quantities offered to any person, region or jurisdiction on a case-by-case basis.

SECTION 3 — ORDERS

When you place an order you are making an offer to buy. We may accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment first.

Please check your order carefully before submitting it. Once an order is accepted we may not be able to accommodate a cancellation request.

If we decline, change or cancel an order, we will try to reach you using the email address, billing address or phone number you provided.

Returns and exchanges are handled solely under our Refund Policy.

You confirm that your purchase is for your own personal or household use, and not for commercial resale or export, unless we have agreed otherwise in writing.

SECTION 4 — PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price that applies is the one in effect when you place your order, as shown in your order confirmation email.

Posted prices include all applicable taxes. Shipping costs are shown separately at checkout. In the rare event that a local customs authority applies an import charge on delivery, contact us and we will resolve it with you.

Promotions may carry their own terms. Where a promotion's terms conflict with these Terms, the promotion's terms apply to that promotion.

You agree to keep your purchase, payment and account information current and accurate so that we can complete your order and contact you if needed.

When you pay by card, you confirm that: the card details you provide are true and complete; you are authorized to use that card; the charge will be honored by your card issuer; and you will pay the posted price including shipping and any applicable taxes.

SECTION 5 — SHIPPING AND DELIVERY

Orders are processed within 1–2 business days after payment is received. We ship to the United States, United Kingdom, Canada, Australia and New Zealand. Estimated delivery is 7–10 business days with standard shipping. Priority shipping is available at checkout with a shorter estimated delivery time; see our Shipping Policy for details. Tracking is emailed to you once your order ships.

All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events outside our control. Responsibility for the package transfers to you once the carrier marks the shipment as delivered.

SECTION 6 — RETURNS, REFUNDS AND WARRANTY

We accept returns within 30 days of delivery when the item is in original condition with its packaging. To start a return, email info@retro-loox.com with your order number. Refunds are issued to the original payment method within 3–5 business days of us receiving the item. Return shipping is paid by the customer.

Our cameras carry a 12-month warranty against manufacturing defects from the date of delivery. The warranty does not cover water or liquid damage, damage from drops or impact, misuse, normal cosmetic wear, or damage caused by third-party accessories, chargers or memory cards.

If you are a consumer in the European Union, you have a statutory right to withdraw from the contract within 14 days of receiving the goods without giving a reason, and you benefit from the statutory conformity guarantee under applicable law. Neither right is affected by anything in this section.

SECTION 7 — PURCHASES THROUGH AI CHANNELS AND AGENTIC STOREFRONTS

Our products are made discoverable to AI shopping channels through Shopify Catalog. Depending on the channel, you may be able to complete a purchase inside that channel, or you may be sent to our checkout at retro-loox.com.

In every case, Retro-Loox is the seller. We fulfill the order, ship it, and handle any return, refund or warranty claim. These Terms apply to your purchase regardless of which channel you bought through.

The AI channel's own terms and privacy practices also apply to your use of that channel. We do not control them and are not responsible for them.

Automated access by shopping agents acting on behalf of a customer is permitted.

SECTION 8 — INTELLECTUAL PROPERTY

The Services — including all trademarks, brand elements, text, images, graphics, video, audio and product photography, and the selection and arrangement of them — are owned by us or our licensors and protected by copyright, trademark and other intellectual property laws.

These Terms allow you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, store or transmit any material from the Services without our prior written consent. Nothing here grants you a license under any patent, trademark or copyright of ours, of Shopify, or of any third party. All rights not expressly granted are reserved.

Retro-Loox and the LOOX product names, logos and designs are our trademarks. Shopify's name, logo and product names are trademarks of Shopify. All other marks appearing on the Services belong to their respective owners.

SECTION 9 — OPTIONAL TOOLS

We may give you access to third-party tools that we neither monitor nor control.

Any such tools are provided "as is" and "as available," without warranties, representations or endorsement of any kind. We accept no liability arising from your use of them. Use them at your own discretion, and make sure you are comfortable with the terms the relevant third-party provider offers them under.

We may add new features and tools to the Services in future. They will also form part of the Services and be covered by these Terms.

SECTION 10 — THIRD-PARTY LINKS

The Services may link to, or embed functionality from, websites operated by third parties. We do not examine or evaluate their content or accuracy, and you access them at your own risk.

We are not liable for any harm arising from your use of third-party sites or from products you buy there. Please read their policies before transacting with them. Questions or complaints about third-party products and services should be directed to that third party.

SECTION 11 — RELATIONSHIP WITH SHOPIFY

Retro-Loox is powered by Shopify, which enables us to provide the Services to you. However, any sale or purchase you make in our store is made directly with Retro-Loox. By using the Services you acknowledge that Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage or loss resulting from products or services purchased. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with us.

SECTION 12 — PRIVACY

All personal information we collect through the Services is handled under our Privacy Policy. Some personal information may also be subject to Shopify's own privacy policy, available at https://www.shopify.com/legal/privacy/app-users.

Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to Shopify and to third parties that may be located in countries other than where you live, in order to provide the Services to you. SECTION 13 — REVIEWS AND CUSTOMER CONTENT

If you send us photos, videos, reviews, ideas, suggestions or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display it in any medium and for any purpose, including marketing.

You confirm that you own or have all necessary rights to the Feedback, that you have disclosed any compensation or incentive you received for submitting it, and that it complies with these Terms.

We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

We may, but are not required to, monitor, edit or remove Feedback we consider unlawful, abusive, obscene, defamatory, infringing or otherwise objectionable.

Your Feedback must not violate anyone's rights, must not contain unlawful or obscene material, and must not contain viruses or malicious code. You may not use a false email address or misrepresent who you are. You are solely responsible for the Feedback you submit, and we accept no liability for Feedback posted by you or any third party.

SECTION 14 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability.

We may correct any error and may change, update or cancel an order at any time without prior notice if the information it relied on was inaccurate — including after you have submitted the order.

SECTION 15 — PROHIBITED USES

You may use the Services for lawful purposes only. You may not use them, directly or indirectly: for any unlawful or malicious purpose; to break any applicable law or regulation; to infringe our intellectual property rights or anyone else's; to harass, abuse, defame or harm our staff or any other person; to transmit false or misleading information; to send spam or unsolicited promotional material; to impersonate any person or entity; or to interfere with anyone else's use of the Services or expose us, Shopify or our users to liability.

You also agree not to: upload viruses or malicious code; reproduce, duplicate, copy, sell or resell any part of the Services; collect or track other people's personal information; phish, pharm, pretext, spider, crawl or scrape, except for automated access by shopping agents acting on behalf of a customer as permitted in Section 7; or interfere with or circumvent the security features of the Services or any related site.

We may suspend, disable or terminate your account at any time, without notice, if we determine you have breached these Terms.

SECTION 16 — TERMINATION

We may terminate this agreement or your access to the Services at any time at our discretion and without notice. You remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Intellectual Property, Reviews and Customer Content, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Privacy — along with any other provision that by its nature should survive.

SECTION 17 — DISCLAIMER OF WARRANTIES

Information on the Services is provided for general information only. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY US, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

SECTION 18 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS — NOR THOSE OF SHOPIFY AND ITS AFFILIATES — SHALL BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT BOUGHT THROUGH THEM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under applicable consumer law.

SECTION 19 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless Retro-Loox, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers against any loss, damage, liability or claim, including reasonable legal fees, payable to a third party and arising out of: your breach of these Terms or any document they incorporate; your violation of any law or of a third party's rights; or your access to and use of the Services.

We will notify you of any claim we seek indemnity for. A delay in notifying you does not release you from your obligations unless you are materially prejudiced by it. We may control the defense and settlement of the claim at your expense, including the choice of counsel, but will not settle a claim that imposes non-monetary obligations on you without your consent, which you will not unreasonably withhold. You agree to cooperate in the defense, including by providing relevant documents.

SECTION 20 — SEVERABILITY

If any provision of these Terms is found unlawful, void or unenforceable, it will still be enforced to the fullest extent permitted by law, and the unenforceable part will be treated as severed. That finding does not affect the validity or enforceability of the remaining provisions.

SECTION 21 — WAIVER; ENTIRE AGREEMENT

If we fail to exercise or enforce any right or provision of these Terms, that is not a waiver of that right or provision.

These Terms, together with any policies or operating rules we post on this site, are the entire agreement between you and us regarding your use of the Services, and supersede any earlier agreements, communications or proposals, whether spoken or written, including any prior version of these Terms.

Any ambiguity in these Terms will not be interpreted against the party that drafted them.

SECTION 22 — ASSIGNMENT

You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent; any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent and without notice.

SECTION 23 — GOVERNING LAW

These Terms, and any separate agreement under which we provide the Services, are governed by the law of the Republic of Slovenia, and the courts of Slovenia have jurisdiction.

If you are a consumer, you keep the protection of any mandatory consumer law provisions that apply in your country of residence, and you may bring proceedings in the courts of that country where applicable law allows.

If something goes wrong, please contact us first at info@retro-loox.com — most issues are resolved quickly by email. If we cannot resolve it, consumers in Slovenia and the EU may use the out-of-court consumer dispute resolution procedures available under applicable law.

Headings are included for convenience only and do not limit or otherwise affect these Terms.

SECTION 25 — CHANGES TO THESE TERMS

You can review the current version of these Terms at any time on this page.

We may update, change or replace any part of these Terms by posting the update to our website, and it is your responsibility to check this page periodically. We will notify you of material changes as applicable law requires, and those changes take effect on the date given in the notice. Continuing to use the Services after a change is posted means you accept it.
